Originality is our signature. We defend it.
Nunk New York takes the unauthorized copying of its protected work, counterfeiting and deceptive impersonation seriously. We are prepared to pursue formal enforcement when our rights are infringed. Public access to our store is not permission to appropriate our brand.
Website operator
This store operates under the Nunk New York / N.N.Y trading identity. Our public business and contact details are available on the Contact information page. This Legal Notice explains our approach to intellectual property and unauthorized use of the brand.
Our name. Our identity.
Nunk New York, NUNK and N.N.Y are used as brand identifiers for this business. We reserve the trademark and unfair-competition rights available to us under applicable law. Do not use our name, logos or other protected identifiers in a manner likely to confuse customers about the origin, sponsorship, endorsement or affiliation of a business, product or service.
This includes deceptive storefronts, product listings, packaging, advertisements, social accounts and domain names that falsely suggest they are operated, approved or supported by Nunk New York. Counterfeit products and false claims of an official partnership are not authorized.
Protected content and creative assets
To the extent protected by applicable law, the original editorial copy, photography, artwork, graphics, videos, packaging artwork and other creative material presented by Nunk New York are owned by or licensed to the relevant rights holders. We reserve the rights we hold in those materials and in any legally protectable elements of our presentation.
Except where a license or the law permits it, you must obtain authorization from the relevant rights holder before reproducing, republishing, adapting, distributing or commercially exploiting protected material. This includes lifting product descriptions, copying campaign imagery or reusing packaging artwork for another business.
Changing a few words, cropping an image, removing a logo, adding attribution or rearranging copied material does not, by itself, create permission or eliminate infringement.
How we may enforce our rights
Depending on the evidence and the rights involved, our response may include:
- Preserving records of suspected infringement and requesting that unauthorized use stop.
- Submitting substantiated intellectual-property complaints to marketplaces, social platforms, advertising networks, hosting providers or other relevant services.
- Sending formal cease-and-desist demands or pursuing an appropriate domain-name dispute process.
- Seeking court orders, damages, an account of profits, or recovery of legal costs where those remedies are available and their legal requirements are met.
We may act through authorized representatives and do not promise an informal warning before taking a lawful enforcement step. A decision not to act in one instance does not, by itself, grant permission for that use or waive our rights in other instances. The action and remedies available depend on the facts and applicable law.
Permission has a defined scope
For a collaboration, press request or proposed commercial use of our protected assets, contact us with the material involved, the intended use, the channels and the proposed duration. Where our permission is required, obtain it in writing before use. Permission for one campaign or purpose does not automatically cover another. Silence is not approval.
Lawful use and third-party rights
This notice respects fair use, lawful quotation, honest reviews, commentary, comparative advertising and other exceptions or rights recognized by applicable law. Ordinary browsing, linking to our store and retaining your purchase records are welcome. We do not claim ownership of general ideas, facts, public-domain material or third-party assets. Shopify software, theme components, fonts, supplier materials and other licensed resources remain subject to their respective ownership and license terms.
Report copying or a rights concern
If you find a suspected copy, counterfeit listing or account impersonating Nunk New York, use our Care Desk and select “Brand protection / IP report.” Include the relevant links, a description of the material and any supporting screenshots. If you believe material on our own store infringes your rights, identify the original work, the material at issue, your authority to act and a reliable way to contact you.
We will assess sufficiently detailed reports and take appropriate action. All rights held by the respective rights holders are reserved, subject to applicable law.
